Hosting Fees will be incurred by the user in subsequent years. Dot com and dot com.au registration will expire after a period of two years from the date of registration. Trace Web Solutions will notify the owner of the respective registration 1 month prior to expiration. In the case of satisfaction of design, further costs will be incurred at the scheduled rates for redesign of websites. There is no provision for a refund following satisfaction of the completed website by Trace Web Solutions. Trace Web Solutions reserves the right to refuse or suspend service and/or access to its servers to any person.

 All accounts are to be determined and agreed upon by Trace Web Solutions and client dependent upon the plan chosen by the client. Trace Web Solutions reserves the right to increase prices of accounts save for the period of prepayment. Payment is organised dependant upon the date the account was established. Clients will automatically be charged at the end of their prepay period unless written closure notification has been provided to Trace Web Solutions not less than 14 days prior to the expiration of the registration period. Where in the case of an account holder providing debit or credit card details and the debit is declined, Trace Web Solutions may immediately suspend the service until the outstanding charge is received. In addition, Trace Web Solutions reserves the right to suspend all other services until the outstanding debt is received. The client is responsible for all monies owed on the account from the time it was established to the time that the customer provides written advice as to the cancellation.

Trace Web Solutions accepts the following payment methods: Cheque, Money Order or Cash.

 Trace Web Solutions reserves the right to cancel or suspend an account at any time. In the event of cancellation or suspension, clients will be entitled to a pro rata payment based upon the remaining period of service. If a customer contravenes any of the terms of service, no refund will be provided Clients may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Fees incurred by Trace Web Solutions in relation to set-up of accounts, registration of domain names and hosting services are non refundable.

 This agreement shall be governed in all respects by the laws of Victoria, Australia. The parties to this agreement shall irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

 Each provision of this agreement including these terms of service is severable and if provisions of this agreement or Terms of service are held to be invalid or unenforceable such provisions may be removed and the remaining provisions may be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of each section.

 The client agrees that it shall defend, indemnify, save and hold Trace Web Solutions harmless from any and all demands, liabilities, losses, costs and claims, including legal costs (on an indemnity basis or solicitor/client basis, whichever is higher) claimed or asserted against Trace Web Solutions, its agents, its customers, officers and employees, that may arise or result from any service provided or omitted, performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. The customer agrees to defend, indemnify and hold harmless Trace Web Solutions against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed; (2) any material supplied by a client infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement.

 Trace Web Solutions will not be responsible for any damage, loss or liability the customer or any third party may suffer. Trace Web Solutions provides no warranties of any kind, expressed or implied for services provided. Trace Web Solutions disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Trace Web Solutions and its employees or otherwise. Trace Web Solutions reserves the right to revise its policies at any time.
